YoAsumo Terms and Conditions of Use
Last updated: September 4, 2026
This English version is provided for your convenience only. The controlling text is the Spanish version available at /terminos; in the event of any conflict or discrepancy between the two versions, the Spanish version will prevail.
1. Acceptance of the Terms
These Terms and Conditions (the “Terms”) constitute a legally binding agreement between you (“you” or the “User”) and [LEGAL ENTITY NAME], a [ENTITY TYPE, e.g. limited liability company] organized under the laws of [JURISDICTION OF ORGANIZATION], with a principal address at [ADDRESS](“YoAsumo”, “we” or the “Company”), governing your access to and use of the YoAsumo web application and all related services (collectively, the “Service”).
By creating an account, accessing, or using the Service in any way, you represent that you have read, understood, and agreed to be bound by these Terms, as well as any policy incorporated by reference. If you do not agree to these Terms, you must not create an account or use the Service.
2. Description of the Service
YoAsumo is an organizational and record-keeping tool that allows a person who pays child support to keep a history of their payments, schedule reminders, generate PDF reports of their payment history, and initiate individual payments through third-party payment processors (ATH Móvil, PayPal, and Stripe, depending on the User’s plan). The Service also allows managing more than one child-support “case” under a single account, each with its own custodial party, support terms, and payment history.
YoAsumo is not affiliated with, sponsored by, endorsed by, or in any way connected to the Administración para el Sustento de Menores (ASUME) of the Government of Puerto Rico, nor to any other court, government agency, or official child-support program, in Puerto Rico or any other jurisdiction. “YoAsumo” is simply the Service’s trade name and should not be interpreted as indicating any government affiliation.
3. Nature of the Service; Not Legal Advice
The Service is exclusively an organizational, record-keeping, and payment-facilitation tool. The Service does not:
- determine, calculate, modify, enforce, or otherwise affect any child-support obligation established by a court, ASUME, or any other competent authority;
- constitute legal, financial, accounting, or tax advice of any kind, nor does it replace consultation with a qualified attorney, accountant, or other professional;
- guarantee that any records, reports, or receipts generated by the Service will be accepted as valid or sufficient evidence before any court, government agency, or counterparty; nor
- replace or excuse the User from complying with any applicable court, administrative, or ASUME order, regardless of what the Service shows or records.
The User is solely responsible for verifying compliance with their legal child-support obligations through the appropriate official channels, and for keeping any receipt or documentation that a competent authority requires independently of the Service.
4. Eligibility and Account Registration
To use the Service, you must (a) be at least 18 years old, (b) have the legal capacity to enter into a binding contract, and (c) not be barred from using the Service under the laws of Puerto Rico, the United States, or any other applicable jurisdiction.
You may create an account with an email address and password, or through an external login provider (Google, Facebook, Microsoft, or Apple). You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
You agree to provide truthful, accurate, and up-to-date information during registration and continued use of the Service, including information about the custodial party and the support terms you record for each case.
5. Third-Party Information; User Consent
When creating or editing a case, you may enter personal information about the corresponding custodial party (name, phone number, and email address), and you may choose to have the Service send that person an email or WhatsApp notification when a payment is recorded. By providing this information and enabling such notifications, you represent and warrant that you have the right to share that information with us for these purposes, and that sending such notifications does not violate that person’s rights or any applicable law. You agree to indemnify us against any claim arising from the misuse of third-party information you enter into the Service.
These notifications are sent through third-party email and messaging providers on a best-effort basis: we do not guarantee that a notification will be delivered, received, or read, and we are not responsible for the consequences of an undelivered notification.
6. Plans, Pricing, and Billing
The Service offers a free plan (“Gratis”) and paid plans (“Tier 1”, “Tier 2”, and “Ilimitado”), each with its own features and payment-history limits, as described in the application at the time you select a plan. We reserve the right to modify the features, limits, or prices of any plan at any time; any change will apply prospectively and, where reasonably possible, you will be notified in advance.
Paid plans are billed as a one-time charge for the selected period (monthly or annual) at the time you choose and confirm the plan. Paid plans do not renew automatically — once the paid period ends, your account remains on the contracted plan until you manually select and pay for a new period; the Service will not make any additional charge without an affirmative action on your part. It is your responsibility to renew your plan before the current period ends if you wish to continue enjoying its benefits without interruption.
All prices are stated in U.S. dollars (USD) and do not include applicable taxes, which, if any, are the User’s responsibility.
7. Payments Through Third-Party Processors
Payment for your subscriptions, as well as any individual child-support payments you initiate from the Service, are processed through independent third-party payment service providers, including ATH Móvil, PayPal, and Stripe, depending on the method you select and your contracted plan. YoAsumo does not process, hold, custody, or transmit funds directly — it only initiates and records the transactions you authorize through these third parties. Your use of each of these services is subject to that third party’s own terms, conditions, and privacy policies, which you must independently review and accept.
We are not responsible for errors, delays, failures, interruptions, or disputes related to these third-party processors, including, without limitation, a payment that does not complete, that is sent to an incorrect recipient due to information provided by the User, or that is declined by the corresponding processor. Any claim related to a transaction processed by a third party must be directed to that third party.
The User may also choose to log a payment manually, without any transfer of funds through the Service. In that case, YoAsumo only keeps a record of the information the User enters, without independently verifying that the payment actually occurred.
8. Refund Policy
Except as required by applicable law, all charges for paid plans are final and non-refundable, including if the User does not use the Service during all or part of the paid period, or decides to cancel or stop using the Service before that period ends. [Confirm with legal counsel whether to offer any refund or cancellation period, particularly in light of any applicable consumer-protection law in Puerto Rico.]
9. Privacy and User Data
To operate the Service, we collect and store information you provide directly to us, including your profile information (name, phone number, email), your case information (including information about the corresponding custodial party), your payment information, and billing information processed by our payment providers. This information is used exclusively to operate, maintain, and improve the Service, and for features you expressly enable (such as sending notifications to the custodial party).
[This section summarizes data handling at a general level; we recommend publishing a separate, more detailed Privacy Policy, reviewed by an attorney, that accurately describes the data collected, its legal basis, the subprocessors/service providers used (including Supabase for authentication and database, and the payment providers mentioned above), the User’s rights, and retention periods.]
10. Acceptable Use
You agree not to:
- use the Service to enter false, fraudulent, or misleading information, including regarding payments that did not actually occur;
- use the Service to harass, threaten, or intimidate the custodial party or any other third party;
- attempt to gain unauthorized access to other Users’ accounts, to the Service’s systems, or to administrative information;
- interfere with the normal operation of the Service, including through reverse engineering, scraping, or the introduction of malicious code; nor
- use the Service in violation of any applicable law or regulation.
We reserve the right to suspend or terminate any account that, in our reasonable judgment, violates this section.
11. Intellectual Property
The Service, including its software, design, text, graphics, logos, and other content (excluding the information you enter), is owned by the Company or its licensors and is protected by applicable intellectual property laws. These Terms do not grant you any rights to the Service beyond a limited, personal, non-exclusive, non-transferable, and revocable license to use the Service in accordance with these Terms.
12. Termination and Cancellation
You may stop using the Service at any time. Currently, you can delete cases and their associated payment history directly from your account; to request deletion of your account and personal data, you must contact us as described in Section 18. We will process such a request within a reasonable time, subject to any legal retention obligations that apply to us.
We may suspend or terminate your access to the Service, with or without prior notice, if you breach these Terms, if your account shows fraudulent or suspicious activity, or for any other reason at our sole discretion, including discontinuing the Service in its entirety.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, NOR THAT ANY NOTIFICATION, REPORT, OR RECORD GENERATED WILL BE ACCURATE OR SUCCESSFULLY DELIVERED.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE COMPANY, ITS OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF REVENUE, DATA, OR ANY LEGAL OR FINANCIAL CONSEQUENCES ARISING FROM A PAYMENT NOT MADE, RECEIVED, OR NOTIFIED ON TIME, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY’S TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
[Verify with legal counsel whether Puerto Rico or any applicable law restricts the enforceability of these limitations, particularly against a consumer.]
15. Indemnification
You agree to indemnify and hold harmless the Company and its officers, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising from: (a) your use of the Service; (b) your breach of these Terms; (c) information you enter about third parties, including the custodial party; or (d) your violation of any law or a third party’s rights.
16. Changes to These Terms and to the Service
We may modify these Terms at any time. We will notify you of material changes by posting the updated version on the Service and updating the “Last updated” date at the top of this document. Your continued use of the Service after such changes are posted constitutes your acceptance of the modified Terms. We may also modify, suspend, or discontinue the Service or any of its features, at any time and without prior notice.
17. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to its conflict-of-laws provisions. Any dispute arising from or related to these Terms or the Service will be subject to the exclusive jurisdiction of the state or federal courts located in Puerto Rico, and you consent to such jurisdiction and waive any objection based on forum non conveniens.
[Evaluate with legal counsel whether to include a mandatory arbitration clause or class-action waiver, and its enforceability under applicable law.]
18. Contact
For questions about these Terms, or to request deletion of your account and personal data, you may contact us at: [LEGAL CONTACT EMAIL].
19. General Provisions
If any provision of these Terms is found to be invalid or unenforceable, that provision will be interpreted in a way that reflects the parties’ original intent to the greatest extent possible, and the remaining provisions will remain in full force and effect. These Terms, together with any policy incorporated by reference, constitute the entire agreement between you and the Company regarding the Service, and supersede any prior agreement on the same subject. You may not assign these Terms without our prior written consent; we may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
